Changes to the way we procure

On 26th February 2015 the most significant changes to procurement legislation in a decade come into force. Read on for some of the changes.


No more PQQs for local tenders

The Government wants to remove the burden of having to submit pre-qualifications questionnaires (PQQs) as the process was onerous for suppliers. The PQQ document is therefore being scrapped in favour of a self-certification system, under which all local (below EU threshold) tenders will be open, and compliance checks will only be undertaken on the successful tenderer just before the contract award. This will mean that, assuming a business meets all compliance standards, it will only need to go through the process of checks for contracts that it wins.


All tender documentation must be available electronically at the time an advert is placed, and all tenders above £50,000 must be advertised on Contracts Finder. Horsham, Crawley and Mid Sussex’s shared procurement service will be rolling out e-tendering in the next few months.

Pre-tender engagement

The new regulations formalise recent moves to encourage pre-market engagement with suppliers. Local government departments can formally meet suppliers to seek advice on what is realistic, before finalising and advertising the tender. However, any information provided to suppliers in this way must be disclosed to all suppliers interested in the tender to avoid discrimination.
